The second type of list also has the word “exclusive” in it, but don`t be confused! It is called the “exclusive agency” agreement. This way, you are the only agent who has the right to sell the property – but you are not the only person to have this right! This agreement describes the conditions under which the agent helps the owner find a buyer to buy his property. So how do you sell this house if you have the exclusive offer? Well, the most common step is to share it with the buyer`s agent on the MLS (multiple listing service, if you remember) and your commission. In this way, the buyer`s broker becomes a cooperating broker and you have made the choice to share your commission with them. You are not allowed to do so, but you have offered to share it with them so that they bring you a suitable buyer. This is by far the most common scenario, and the one that constitutes the strongest link between the seller and the agent. The agreement allows them to list the property and, in most cases, to offer them the exclusivity of the real estate transaction and the potential commission won. Other conditions are defined in the agreement, such as the list price, commission rate or agent fee, the duration of the bidding period, advertising methods and all other conditions requested by the Seller. Once the list contract is signed by the agent and the seller, the parties are bound by the terms until the contract expires or the property is sold.
